Acceptance of Orders
The following terms and conditions apply to all (online & offline) transactions. These terms and conditions do not affect your statutory rights.
The placing of an order indicates your acceptance of these terms and conditions.
We have the right to refuse at our discretion to supply any goods ordered by you.
Pricing & Payment
By default all the prices shown on this website are exclusive of vat.
The property of the goods remains with ‘Care Home Furniture’ until full payment has been received.
We reserve the right to to correct website errors and omissions at any time.
We may on occasions reject an order if the product(s) have been mispriced by us. In these situations we will refund any amounts that have been paid.
Description of Goods
Every reasonable care has been taken to ensure that the descriptions are accurate.
All images are for illustrative purposes only. We have made every effort to display finish and upholstery colours as accurately as possible.
All dimensions are rounded up to the next centimetre.
You are solely responsible for ensuring that each product you order is suitable for purpose for which it is required.
Delivery
Every product page on this website itemises the type of delivery service, lead time, postcode area coverage and delivery charges. It is essential the customer reads the delivery information for each product they order as details; lead times, eligible postcode areas, delivery charges, and delivery service levels, differ between products
The customer shall make all arrangements necessary to take delivery of the goods.
Delivery dates are estimates only and cannot be guaranteed. We shall not be held liable for any delay in delivery, nor the consequences thereof..
Damage in Transit & Shortages
We must be notified advise of damage or shortages within 48 hours of receipt of the goods.
We will require photographs of the damage product(s) clearly identifying the area and extent of damage.
Cancellations
All our products are 'made-to-order' in accordance with the customer's choice of fabric, wood stain, cabinet finish and other ancillary items such as fitted locks. Goods cannot be exchanged and orders cannot be cancelled once manufacture has commenced.
If the goods have not gone into production, or if materials such as fabrics and chair frames have not yet been sourced, we will change or cancel your order and refund your full payment without charge.
Warranty
Faulty goods must be reported to us with a full description of the fault. Photographs of the faulty item are required.
If a fault is deemed to be a manufacturing fault and the item is under guarantee then we will replace the item free of charge. Goods subjected to excessive wear and tear, misuse, defective maintenance, alteration or modification, are excluded from the manufacturer’s warranty.
Ownership Of Rights
All rights, including copyright, in this website are owned by 'Care Home Furniture'. Any use of this website or it's contents, including copying or storing in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of ‘Care Home Furniture’.
You may not modify, distribute or re-post anything on this website for any purpose.
Liability
In the event of any breach of these Terms and Conditions by us the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages.
Force Majeure
We will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.
Waiver
Our failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.
Severability
In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
