The following terms and conditions apply to all (online & offline) transactions. The placing of an order indicates your acceptance of these terms and conditions. These terms and conditions do not affect your statutory rights. 

We have the right to refuse at our discretion to supply any goods ordered by you.

Advice and Suitability of Products

All goods purchased from Care Home Furniture are at the request of the purchaser. We cannot guarantee that any product purchased on this site, either by phone or online, is totally suitable for your personal requirements. This is a responsibility you must accept yourself. Any information offered by any member of our staff, either on the phone or online, is for general guidance purposes only. If you have any doubts at all as to the suitability of any specific product for your own use, we recommend that the opinion of a qualified Occupational Therapist is sought prior to purchase.

Description of Goods

Although we warrant that the goods will, at the time of delivery, correspond to the description given by us, we are not able to publish detailed specifications. All images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods. Except where the customer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977, section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or conditions of the goods whether implied by Statute, Common Law or otherwise are excluded and the customer warrants that the customer is satisfied as to the Suitability of the Goods for the customer's purpose. Goods are not sold on a trial basis. 

If you buy goods which have no published technical specifications, it is your responsibility to establish the suitability of the goods for your intended purpose. 

Typographical Errors/Accuracy Of Content

‘Care Home Furniture’ has taken every care in preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. Should an error on price occur, and an order is placed, you will be informed and given the option of continuing the order at the correct price, or cancelling the order. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods you will receive a full refund.

We reserve the right to refuse or cancel an order based on incorrect prices whether or not the order has been confirmed.

All images, dimensions, specifications are displayed as clearly as possible on the website. We have also made every effort to display our product/fabric colours and finishes as accurately as possible. Dimensions are mostly shown in, and rounded up to the nearest centimetre. 

'Care Home Furniture' will not be liable for any inaccuracies or errors on the website

Ordering/Payment

You can place an order with us following our online shopping and checkout system. Payment options are by online BACS, credit card or cheque; or by Purchase Order from government bodies and other approved organisations.

Once you have placed an order you will receive a confirmation email that states the exact goods ordered, with an order reference number. A full VAT receipt will be emailed to you as soon as payment has been received.

Payment is by the following methods:

BACS Payment. Order is processed once payment is received.

Cheque by post. Order is processed once cheque is cleared.

Purchase Order from government bodies (NHS, councils, universities, schools etc.). An order is processed upon receipt. Payment will due be upon delivery or on a pre-agreed credit facility basis. We may require further validation from the government body before proceeding to process a purchase order. If this is the case we will contact you. Deposit payments may be required for larger orders.

All prices exclude VAT (where applicable) at the applicable current rate. The property of the goods remains with ‘Care Home Furniture’ until full payment has been received.

Availability of Goods

All products are subject to availability or may be withdrawn at any time. It is our policy to contact you if a product is out of stock. If you do not wish to proceed with the order, or for any reason we cannot supply the product, we will arrange for the order to be cancelled. 

Delivery

All deliveries  are made using the factory's own transport.The only exception to this is the occasional use of a pallet delivery service. A pallet delivery service is only used to support the regular furniture van delivery service in exceptionally busy periods, or to provide extra coverage to areas outside our normal delivery catchment area.

Cabinet (Bedroom, Living and Challenging Behaviour) products and Upholstery (Lounge and Dining) products are dispatched from different warehouses. Therefore, orders with with items from both product groups may be delivered on different dates. Orders are not automatically completed on one delivery.

We will contact you when your order, or each part thereof, is ready for dispatch, to advise a delivery date. 

We always aim to deliver in the time frame stated but we cannot guarantee this as delays are occasionally inevitable due to unforeseen factors. ‘Care Home Furniture’ shall not be liable for any losses incurred by the buyer as a result of any delay in delivery of the goods.

Damage in Transit & Shortages 

As internal damage cannot always be identified on delivery, the customer must sign the driver's manifest as “unchecked”. Please advise us within 48 hours of receipt of the goods if damage is found upon opening packages. We will require pictures of damage products to enable us to resolve the problem as soon as possible. It is imperative that the customer does not dispose of any of the packaging, as this will be required to affect a claim against the carrier.  We cannot accept any claims for damage if the above time scales are not followed. 

It is the customer's responsibility to sign for the correct number of packages that are delivered; the customer is required to check that the number of packages delivered equal the number of packages on the delivery driver's manifest/consignment note. Any shortages must be noted on the driver's manifest and it is the customer's responsibility to thereafter notify us within 48 hours of delivery. 

Should the customer be missing an item but has signed for the full number of packages, the customer must notify us within 48 hours of delivery. The matter will be investigated immediately and the customer will be advised.

Faulty & Incorrect Goods 

If you think that the product you have purchased is faulty we may refer you to the manufacturer. If the manufacturer agrees that the product is faulty, in most cases they will be able to authorize a replacement/repair of the product direct to you. This does not affect your statutory rights.

It is the customers responsibility to notify us of any incorrect goods supplied within 48 hours of delivery. If the items are not as ordered the customer must not open the manufacturers packaging or use the item.

Cancelling or Changing Orders

Most items at ‘Care Hme Furniture’ are made-to-order products. If you wish to cancel or change an order, call us as soon as possible on 07788 234574, or email us with your change/cancellation request details.

If the goods have not yet been manufactured we will change your order as per your request, or cancel your order and refund your full payment free of charge. If the made-to-order goods have already been manufactured we will charge 100% of the order price as these goods cannot be returned to the manufacturer. 

If 'Non Made-to-Order' or standard 'ex stock' products have not been dispatched we will change the order as requested or cancel it and refund your full payment free of charge. If your order has been dispatched we will charge a cancellation fee of 20% of the order price which will cover the cost of returning and re-stocking the order. Refunds will not be processed unless the goods are packaged in their original packaging and are in a saleable condition.

Warranty

Any faulty goods under warranty must be reported to us with a full description of the fault. We will also require pictures of the faulty item. If the fault is deemed to be a manufacturer fault and the item is under guarantee then we will replace the item free of charge. Goods subjected to excessive wear and tear, misuse, defective maintenance, alteration or modification, are excluded from the manufacturer’s warranty offered.  

Ownership Of Rights

All rights, including copyright, in this website are owned by 'Care Home Furniture'.  Any use of this website  or it's contents, including copying or storing in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of ‘Care Home Furniture’. You may not modify, distribute or re-post anything on this website for any purpose.

Liability

Except as may be implied by law and except in the case of death or personal injury where the customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by us the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages.

Force Majeure

We will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.

Waiver

Our failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions. 

Severability

In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law. 

General

The content of the pages of this website is for your general information and use only. It is subject to change without notice. Unauthorised use may give rise to a claim for damages and/or be a criminal offence.

From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible.

Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.

These terms and conditions do not affect your legal rights.
